We thank you for choosing the services of Trademark Seva (a unit of Nishant & Co.). Please read this Refund Policy carefully before purchasing any service through https://trademarkseva.com/ (“Website”).
This Policy is issued in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”), and the Digital Personal Data Protection Act, 2023 (“DPDP Act”) together with the DPDP Rules, 2025, to the extent applicable and as they come into force in a phased manner.
1. Information We Collect
1.1 Personal Information
When you use the Site — including registering, requesting a Trademark Availability Report, placing an order for filing services, or contacting our support team — we may collect:
- Full name
- Mobile number and/or email address
- Billing and mailing address
- Business/brand name and details submitted for trademark search or filing
- Payment and transaction details (processed via secure third-party payment gateways)
- Any documents you upload for filing, prosecution, or advisory services
You may browse parts of the Site without providing personal information, but certain services — including generating a Trademark Availability Report or filing a trademark application — require it.
1.2 Non-Personal Information
We automatically collect technical information such as browser type, device type, IP address, operating system, and general usage patterns when you interact with the Site, for analytics and security purposes.
1.3 Information Generated by Our Tools
Our AI-assisted trademark search tool processes the brand name and business description you submit to generate a Trademark Availability Report. This report is generated using automated text-similarity analysis of publicly available trademark register data and is indicative only — it does not constitute a legal opinion, and any risk score or class recommendation shown should be independently verified before you rely on it for filing decisions.
2. Cookies
The Site may use cookies to improve user experience, remember preferences, and analyze traffic. You may configure your browser to refuse cookies; doing so may limit some Site functionality (such as saved search history or account login).
3. How We Use Your Information
We use collected information to:
- Generate and deliver Trademark Availability Reports and related search results
- Process and fulfil filing, prosecution, opposition, and advisory service orders
- Communicate with you regarding your order, application status, deadlines (e.g., objection/opposition windows), and support requests
- Process payments for our File / Protect / Complete plans and applicable government fees
- Improve our Site, tools, and services based on aggregated usage data
- Send service-related updates, and, where you have opted in, promotional communications (with an option to unsubscribe at any time)
- Comply with applicable law, including recordkeeping obligations under the Trade Marks Act, 1999 and Trade Marks Rules, 2017
4. Legal Basis and Consent
Where required under the DPDP Act, we process your personal data on the basis of your consent, given at the time you submit information through the Site, or where processing is necessary to perform services you have requested (e.g., filing your trademark application) or to comply with a legal obligation. You may withdraw consent at any time by contacting us, subject to the effect this may have on services already initiated (such as a pending trademark application, which cannot be withdrawn from the Registry solely by withdrawing consent to us).
5. Sharing and Disclosure of Information
We do not sell your personal information. We may share information:
- With the Trade Marks Registry / IP India and other statutory authorities, as necessary to file, prosecute, or defend your trademark application
- With empanelled trademark attorneys/agents engaged to review, verify, or represent your application
- With third-party service providers (e.g., payment gateways, cloud hosting, communication tools) strictly for the purpose of operating the Site and fulfilling your order, under confidentiality obligations
- With group/sister concern entities, only where necessary to provide a service you have requested, and subject to their own privacy practices, for which we are not responsible
- Where required by law, court order, or governmental request
- In connection with a merger, acquisition, or business restructuring, with prior notice to affected users where feasible
We are not responsible for the privacy practices of any third-party site linked from our Site, and we recommend reviewing their policies independently.
6. Data Security
We implement reasonable security practices as required under the SPDI Rules and the DPDP Rules, including:
- SSL/TLS encryption for data transmitted through the Site
- Access controls restricting internal access to personal data on a need-to-know basis
- Secure storage of documents and application data submitted for filing
- Retention of processing logs and safeguards in line with applicable regulatory timelines
No method of transmission or storage is completely secure; while we strive to protect your information, we cannot guarantee absolute security.
7. Data Retention
We retain personal information for as long as necessary to provide the services requested, comply with statutory recordkeeping requirements (including under trademark and tax law), resolve disputes, and enforce our agreements. Where the DPDP Act and Rules prescribe specific retention or erasure timelines, we will comply with those timelines as they become applicable.
8. Your Rights
Subject to the DPDP Act and Rules as they come into effect, you may have the right to:
- Access the personal information we hold about you
- Request correction or updating of inaccurate information
- Request erasure of your personal data, where retention is not otherwise required by law (e.g., statutory filing records)
- Withdraw consent for processing, as described in Section 4
- Nominate another individual to exercise your rights on your behalf, as permitted under the DPDP Rules
- Lodge a grievance with our Grievance Officer (Section 11) and, if unresolved, escalate to the Data Protection Board of India
We will respond to verified requests within a reasonable time and in any event within the timelines prescribed by applicable law.
9. Children’s Privacy
Our services are intended for use by individuals who are at least 18 years of age or otherwise capable of entering into a binding contract under Indian law. We do not knowingly collect personal information from children. Where processing of a child’s data is unavoidable (e.g., minor as an applicant with guardian consent), we will obtain verifiable parental/guardian consent as required under the DPDP Act.
10. Third-Party Links and Advertising
The Site may contain links to third-party websites and may display advertisements served by third-party ad networks (which may use cookies for interest-based advertising). We do not control and are not responsible for the privacy practices of such third parties. You may manage ad-related cookie preferences through your browser or the relevant ad network’s opt-out tools.
